New York's banking regulator Benjamin Lawsky unleashed a verbal assault on nonbank servicer Ocwen Financial Wednesday, saying the company's explosive growth "raises red flags," and that its use of technology to better handle distressed loans is "too good to be true."
Speaking at the annual meeting of the New York Bankers Association, Lawsky said Ocwen's public documents make "for startling reading." He sees "corners being cut," by nonbank servicers that have touted their ability to help distressed borrowers.
"We have serious concerns that some of these nonbank mortgage servicers are getting too big, too fast," Lawsky told New York bankers who were meeting at the Waldorf Astoria. "We see far too many struggling homeowners getting caught in a vortex of lost paperwork, unexplained feed and avoidable foreclosures."
Last week, Ocwen put an indefinite hold on its $2.7 billion purchase of servicing rights from Wells Fargo after Lawsky raised concerns about the Atlanta-based servicers' growth.
Yet Lawsky refused to cite Ocwen by name. Instead, he referred to a public document filed with the Securities and Exchange Commission by "a nonbank servicer" that boasted to investors that it was still "in the middle innings of cleaning up the human wreckage left by the mortgage meltdown."
Ocwen has used the "middle innings" reference in presentations in January and in December to analysts and investors.
Lawsky also cited Ocwen's comments to investors that it has identified $400 billion in servicing rights that it plans to acquire in the next 12 to 18 months, and that up to $1 trillion in servicing will change hands in the next few years.
But he took particular umbrage by Ocwen's assertions that it can service delinquent loans at a cost that is 70% lower than the rest of the industry, calling into question its entire servicing model.
"Those kinds of cost-saving claims bear special scrutiny," Lawsky said. "Regulators have to ask whether the purported efficiencies at nonbank mortgage servicers are too good to be true."
As superintendent of New York's Department of Financial Services, Lawsky has jurisdiction over Ocwen as a licensed mortgage banker in New York. He also has additional insight into Ocwen's operations because in Dec. 2012, Ocwen agreed to an independent monitor as part of a consent order that cleared the path for its 2011 acquisition of Litton Loan Servicing from Goldman Sachs.
Lawsky made specific references to servicers' difficulty in handling the transfer of documents and dealing with distressed borrowers.
"We see electronic loan files strewn around the globe with no one who knows how to pull them together," Lawsky said. "We see a virtual potpourri of computer systems containing critical borrower information, but no one who knows how to extract that information at the right time and for the right purpose."
Kevin Barker, an analyst at Compass Point, says it is uncertain whether Lawsky is primarily concerned about Ocwen's ability to take on more distressed loans or if it the concerns relate to past servicing practices — or both.
"It's not easy to transfer the servicing and boarding of all these loans because you have to think about what kind of shape the files are in when they get them," Barker says.
Lawsky has previously used his authority to hold up past transfers of mortgage servicing to Ocwen and to demand concessions such as the independent monitor. Still, servicers are concerned whether his actions will set a precedent that upends other servicing transfers involving New York loans.
"Regulators should not just be rubber stamps," Lawsky told bankers.

Banks, Mortgage Companies Defrauded HUD, Veteran Whistleblower Says
A whistleblower with a track record of wresting large settlements from banks is suing 22 companies for allegedly filing fraudulent mortgage documents with the Department of Housing and Urban Development.
Lynn E. Szymoniak, famous for her 2011 “60 Minutes” interview on the robo-signing scandal, filed a lawsuit late Monday against the companies, including Deutsche Bank, Wells Fargo, JPMorgan Chase and Bank of America. The Palm Beach, Fla., plaintiff’s lawyer alleges the 22 banks, mortgage servicers, trustees, custodians and default management companies created fraudulent mortgage assignments and submitted tens of thousands of false claims to HUD.
The lawsuit is a stark reminder that banks still face massive litigation and potential settlements for wrongdoing from the mortgage boom and financial crisis. On Wednesday, JPMorgan Chase acknowledged that it violated the False Claims Act and agreed to pay $614 million to settle claims that it improperly approved Federal Housing Administration and Veterans Affairs loans that did not meet underwriting standards.
HUD oversees the FHA, which reimburses servicers for losses and fees when government-guaranteed loans go into foreclosure.
Banks can be held liable for treble damages under the False Claims Act if they are found to have "falsely certified" that mortgages met all FHA requirements. The act also gives whistleblowers the right to file suit on behalf of the government.
“It’s been very difficult to uncover how fraudulent documents were created and spread through the system,” says Reuben Guttman, Szymoniak’s attorney at the firm of Grant & Eisenhofer. “Lynn Szymoniak did the original analysis, looked at documents and put the pieces together in a way that nobody else did.”
The new lawsuit was filed in the U.S. District Court in South Carolina. Several of the defendants, including Deutsche Bank and Wells Fargo, said they are reviewing the lawsuit and could not immediately comment.
In 2012, Szymoniak helped the government recover $95 million from the top five mortgage servicers, as part of the $25 billion national mortgage settlement. She personally received $18 million for providing information on the filing of false claims on FHA loans.
The suit also seeks to recover damages and penalties on behalf of the federal government, 16 states, the District of Columbia and the cities of Chicago and New York for the financial harm incurred in the purchase of private-label mortgage-backed securities that allegedly used fraudulent documents in foreclosure filings since 2008.
As investors in mortgage bonds, the government and others paid fees and expenses for services such as reviewing all mortgage documents put into trusts that were supposed to be performed by trustees. The federal government bought mortgage-backed securities with missing or forged documents through several avenues, including the Federal Reserve's direct purchases and Maiden Lane vehicles, and the Treasury Department's purchases through public-private partnership investment funds, the suit states.
The complaint does not specify damages but Szymoniak says she expects them to total around $10 billion.
The fraudulent mortgage documents were created because the original loans documents either were never delivered to the securitization trusts, or they were lost or destroyed, the lawsuit states. Many of the documents were created years after the trusts’ closing dates and showed the trusts acquired the loans only after they were in default.
Servicers “devised and operated a scheme to replace the missing documents,” the lawsuit states, and to conceal the fact that the trusts and servicers never actually held the mortgage notes and assignments, which are needed to initiate a foreclosure.
Szymoniak was also instrumental in uncovering fraud and forged documents at DocX, a now-defunct subsidiary of Lender Processing Services. She worked with the Federal Bureau of Investigations and U.S. Attorney's office in Jacksonville, Fla., that ultimately led to the conviction of an LPS executive, the closure of DocX, firm, and various settlements by LPS, which is now owned by Black Knight Financial Services.

Mortgage-Deal Spoils Divide Winners From Losers
This is priceless. These attorney generals and others make big bank off the people who were frauded by these banks. While there pockets grow , nothing has been done to help the ones who lost homes and were abused the most. pretty sad, when the people sworn to protect you are also stealing from you as well. The only people deserving of this money are the people who were hurt, not the lawyers, not the AG's, not the treasury , and not the governments, yet, they are the ones prospering and the rest are left to struggle with loss, homelessness, no jobs, no food. California Attorney General Kamala Harris, seen by some as a potential gubernatorial candidate in 2018, used her $300 million share from JPMorgan to reimburse public-pension funds for losses on mortgage investments. Lisa Madigan, her Democratic counterpart in Illinois who considered a run for governor this year, applied her $100 million share to the state’s pension systems, which face a worst-in-the-nation $100 billion shortfall. She trumpeted her move with a news release.
“Politics is all about money and power,” said Peter Henning, a former lawyer with the Securities and Exchange Commission and a professor at Wayne State University Law School who has written about the JPMorgan settlement. “AG stands for almost governor.”
New York got $613 million to settle a 2012 case Schneiderman mounted against the bank and its Bear Stearns unit. As the most active in pursuing -- and suing -- the bank, he won the biggest pot. That was enough to aggravate natural tensions with the state’s top political figure.
“When the settlement gets big enough, you have a fight,” said James Tierney, a former Maine attorney general who runs a program about the position in Columbia University’s law program. “Both bring to the table the legitimate functions of their office.”
“It’s counterintuitive, but the chance for sparks to fly is greater when the governor and attorney general are from the same party,” said former New York Attorney General Bob Abrams, who is now a partner with Stroock LLP in New York. “There is a natural suspicion and paranoia, and there can be competing ambitions.”
Such rivalries have been going on for decades, said Tierney, a key adviser in the $246 billion settlement among the tobacco industry, the U.S. government and 46 attorneys general in 1998.
In the 15 years since, governors used the money for bridges, tax relief and other purposes not related to tobacco control or health that the attorneys general had proposed.
States have received $116 billion in payments and spent only 7.7 percent on tobacco prevention programs, said Peter Fisher, vice president for state issues at the Campaign for Tobacco Free Kids.
In later deals, the attorneys general protected their plans. In February 2012, the U.S. and 49 attorneys general reached a $25 billion settlement with five top mortgage servicers, including Bank of America (BAC:US) Corp., whom they accused of signing foreclosure documents without verifying them.
The servicers were told to use as much as $21.5 billion to cut homeowners’ principal payments, refinance loans at lower rates and compensate 2 million people who lost their homes because of malfeasance. Money going directly to the states would protect consumers against foreclosures.
The original deal gave Schneiderman control of 85 percent, with 15 percent going to the state treasury. It said he could use the funds to aid those hurt by the foreclosure crisis and “otherwise promote the interests of the investing public.” He could spend money on housing counselors, mediation, and anti-blight projects, the settlement said.
Matt Mittenthal, a Schneiderman spokesman, said the deal was a “product of positive negotiations.”
Tierney said the conflict between attorneys general and governors can make for good government.
“Most states want the friction between the two,” he said. “They want the AG to stand up to the governor, because it’s a check on the governor’s power.”
The case is People of the State of New York v. J.P. Morgan Securities, 451556-2012, New York State Supreme Court (Manhattan).

Hundreds of millions of dollars in
mortgage-fraud settlements from JPMorgan Chase & Co. and other
banks are providing a windfall to state attorneys general -- and
creating a new class of political winners and losers.
In New York, Attorney General Eric Schneiderman learned in
November his office was getting $613 million from JPMorgan,
about triple his annual budget. He said he’d use the cash to
reimburse victims and finance investigations. Governor Andrew Cuomo, a fellow Democrat, questioned Schneiderman’s hold on the
money and a dispute over the cash ensued. Schneiderman’s Pursuit
In November 2013, the U.S. and five state attorneys general reached an agreement with the bank that it would pay $13 billion to settle claims that it sold risky mortgage securities. JPMorgan, admitting that it and companies it bought hadn’t sufficiently informed investors about risks, paid a $2 billion civil penalty. Snookered Attorneys

Staking Claims
Schneiderman structured New York’s share of the JPMorgan (JPM:US) agreement to give his office broad powers to determine how the funds would be spent, according to the settlement.The original deal gave Schneiderman control of 85 percent, with 15 percent going to the state treasury. It said he could use the funds to aid those hurt by the foreclosure crisis and “otherwise promote the interests of the investing public.” He could spend money on housing counselors, mediation, and anti-blight projects, the settlement said.
Cuomo balked and argued with Schneiderman that the money is
meant to relieve all taxpayers, and the attorney general isn’t
allowed under state law to spend it as he sees fit, according to
an administration official familiar with the discussions who
requested anonymity because the dispute was private.
Schneiderman and Cuomo worked out the dispute over the
first $163 million installment of the four-year payout just
before the governor announced his state budget Jan. 21. The
attorney general will put half into the treasury, and Cuomo and
the legislature will spend it on housing. Schneiderman also
agreed to go through the state contracting process and the
oversight that comes with it when spending the funds. Matt Mittenthal, a Schneiderman spokesman, said the deal was a “product of positive negotiations.”
Struggle Ahead
Three other payouts will follow, leaving Schneiderman with hundreds of millions to disburse in remaining years. Cuomo expects to fight over the division of each, said another aide who requested anonymity because the matter is private.Tierney said the conflict between attorneys general and governors can make for good government.

(MT. PLEASANT, MI) - (New report and video about Ted Visner: Police Attempt to Turn Tables Against Michigan Crime Victim Ted Visner)

of Mt. Pleasant, Michigan, have been living out a nightmare. It started
two and a half years ago, when the family fell victim to an apparent
real estate scam by a local sheriff's department employee.

Ted Visner says they bought their former home on a land
contract, only to learn seven months later, that the seller, Isabella
County Sheriff's Dept. employee Shelly Sweet, was not making monthly
payments on the house. A bank foreclosed on the property, all
unbeknownst to the Visner/Smith family.
Ted Visner, who builds custom homes for a living, said,
"Although we were paying Sweet every month on the purchase of the
property, she had not been paying the underlying mortgage and the home
fell into foreclosure." I asked Visner if he had records of those
payments, he said he does, including canceled checks. You won't believe
what happened next.
"On a weekend Sweet knew that we would be out of town,
she offered the contents of our home to her friends and coworkers at the
Isabella County Sheriff’s Department, claiming we had abandoned the
home. Many took her up on her free offer deal and took over $55,000
dollars worth of our personal property."
Property Vanishes
$55,000 is a big number, but Visner said Sweet availed
all of their personal belongings and private property to anyone who
would take it. Visner tells Salem-News the items taken included beds,
dressers, appliances, his wife's wedding dress which was hermetically
sealed, kids toys, sports equipment, and a whole lot more.

"My kids couldn't play or participate in sports for the
next two years. Other items that disappeared included tax records...
nothing has been recovered."
The story seems blatantly criminal in nature, with
police banding together to help off their property in its entirety.
Visner said, "She just put a sign out and let anybody have what they
wanted, she didn't remember who was there. In her own deposition she
admits to giving our stuff away."
Visner says Sweet told her employer, the sheriff's
department that Visner and his wife weren't making payments, while
Visner is able to prove via canceled checks to Sweet that they were
indeed paying. "It was blatantly untrue," Visner added. "There is no
evidence to support what the county did, it all shows what we are saying
though."
He says the experience has been extremely hard for his
family, adding, "I don't have any criminal background, I served six
years in the Navy on submarines, my wife and I have kids, we don't
deserve this, nobody in the world deserves this."
Visner, Smith and their kids, returned from their
weekend away on Monday September 27, 2010, to discover that they were
locked out of their own home. Visner called the law enforcement agency
that Sweet worked for.
"We had NOT been evicted nor had we abandoned
the property. The woman had convinced friends and coworkers that we had
never paid her, and that were trashing the house and had forced her
into foreclosure -- none of which were true."
It would take a day before the family was allowed to go
back inside of the home, and that is when Smith and Visner learned that
95% of the home's contents had been stolen.
"A sheriff deputy named 'Steinert' came to our home
three times that day and only assisted his coworker while the
under-sheriff, sheriff and PA refused to help us after they recognized
the totality of the situation," Visner said, adding that the "situation"
was 6+ coworkers of Sweet having entered their home and receiving
stolen property, which for anyone else in the world is Theft.
Instead, Visner was arrested for "Misuse of 911" on the
deputy's third visit. "The county investigated the crime for almost
four months and during this time, I moved my family out of Isabella
County for safety, I could not move with them because my indefinitely
delayed arraignment still loomed over my head."
Visner says after losing the home he shared with his family, and 95% of their belongings to the sheriff's department,
that the prosecutor's office ignored their complaints and still refused
to investigate "their employees". In his words, "Over two and a half
years have passed now with law enforcement officials doing nothing
except covering for one another."
Visner says the underlying crime was the conspiracy to
deprive his family’s constitutional rights - that is a federal crime
during the commission of which, he asserts that he was kidnapped
(arrested) by Deputy Steinert on the "bullshit charge" of misusing 911.
Violation of Title 18 U.S.C. §§ 241 and 242 is a federal felony crime where the offenders could be sentenced to death if killing or kidnapping occur.

"Our story needs to go viral, people need to know that
they have to stand up for their rights, when we stop standing for our
rights we won't have them anymore." He concluded that statement by
adding that you only have rights when people in positions of authority
listen.
"The Attorney General is dismissing this serious
crime... For my family and I, there is no recourse, at least not yet.
The AG prohibits complaints of police misconduct and civil rights being
violated. I just wrote a letter to the ACLU and explained this, I
haven't heard back from them yet," Visner said.
Salem-News attempted to reach Isabella County Sheriff
Leo Mioduszewski, he has not returned our call in regard to the Visner
case. An employee of the sheriff's office told Salem-News that the
agency does not have a public information officer.
Is it possible to receive an "F minus" as a
public safety agency? If so, based on the above information, that is
definitely the grade the Isabella County Sheriff's Dept. in Michigan
deserves. You can draw your own conclusions, but these cops appear to
take law enforcement corruption and government misuse of power to all
new levels.
